Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of the NE Provenance platform ("Service"). This AUP is part of and incorporated into our Terms of Service. Violation of this AUP may result in suspension or termination of your account without refund, and may expose you to legal liability.

1. Purpose

NE Provenance provides property intelligence for legitimate professional use. This policy defines what constitutes acceptable and prohibited use of our platform, data, intelligence, and services. Given that our entire product is built on proprietary intelligence derivation, protecting the integrity and exclusivity of that intelligence is essential.

2. Permitted Uses

  • Property underwriting, risk assessment, and insurance decisions
  • Real estate appraisal, valuation, and inspection preparation
  • Mortgage origination, collateral assessment, and portfolio monitoring
  • Title search, ownership verification, and legal due diligence
  • Real estate listing, prospecting, and transaction support
  • Municipal assessment, planning, and code enforcement
  • Environmental due diligence and regulatory compliance
  • Lead generation using search and filter capabilities
  • Academic and policy research with appropriate licensing
  • Individual property lookups for personal due diligence
  • Including NE Provenance intelligence in professional reports prepared for your clients (with attribution)

3. Prohibited Uses — Data and IP Protection

The following activities are strictly prohibited and may constitute violations of our Terms of Service, the Defend Trade Secrets Act, and other applicable laws.

  • Systematic bulk extraction. Downloading, scraping, crawling, or programmatically accessing data beyond reasonable professional use for the purpose of building a competing dataset, derivative database, or data product. This includes incremental extraction that cumulatively constitutes a substantial part of our database.
  • Redistribution. Reselling, sublicensing, syndicating, or distributing NE Provenance data or intelligence to third parties, except as embedded in professional reports you prepare for your clients. This includes providing NE Provenance data through your own API, data feed, or platform to downstream consumers.
  • AI model training.Using NE Provenance data, intelligence metrics, classification outputs, or any content accessed through the platform or API to train, fine-tune, validate, benchmark, or otherwise improve any machine learning model, AI system, neural network, or automated classification system — whether your own or a third party's. This prohibition applies regardless of the volume of data used.
  • Reverse engineering. Attempting to reverse-engineer, decompile, reconstruct, or derive our classification methodologies, scoring algorithms, AI models, source combination rules, derivation logic, conflict resolution hierarchies, or evaluation criteria. This includes analyzing patterns in our outputs to infer our proprietary methods.
  • Competitive benchmarking. Systematically comparing NE Provenance intelligence against competing data products, services, or internally-developed datasets for the purpose of competitive analysis, product development, sales enablement, or marketing by a competing entity. This does not restrict normal evaluation of our product for your own purchasing decisions.
  • Competitive intelligence gathering. Using the platform to systematically evaluate our data coverage, quality, sourcing, methodology, or attribute completeness for the purpose of building, improving, or marketing a competing product or service.
  • Derivative database creation. Using NE Provenance intelligence as an input, seed, or validation source for building a separate database, dataset, index, or data product — whether for internal use or commercial distribution.

4. Prohibited Uses — Platform Integrity

  • Unauthorized automation.Using bots, crawlers, scrapers, or automated tools to access the platform except through our published API within your plan's rate limits. This includes browser automation, headless browsers, and any programmatic access not using our API.
  • Account sharing. Sharing account credentials or API keys with individuals outside your organization, or using a single subscription to serve multiple unrelated legal entities.
  • Circumventing limits. Creating multiple accounts, rotating credentials, or using any technical means to circumvent plan limits, rate limits, or access restrictions.
  • Security interference.Attempting to gain unauthorized access to our systems, other users' accounts, or data. Introducing malicious code. Conducting security testing without written permission. Probing, scanning, or testing vulnerabilities of any system or network.
  • Service disruption. Overloading or disrupting our infrastructure through excessive requests, denial of service attacks, or other means that degrade service for other users.
  • Misrepresentation. Presenting NE Provenance intelligence as your own proprietary data without attribution, or misrepresenting the source, currency, or completeness of the data.

5. Prohibited Uses — Harmful Activities

  • Harassment or discrimination. Using property or ownership data to harass, stalk, discriminate against, or target individuals based on protected characteristics.
  • Fraud. Providing false information during registration, using stolen or fraudulent payment methods, or using the Service for any illegal purpose.
  • Privacy violations. Using property intelligence to conduct unauthorized surveillance, doxxing, or other invasions of privacy beyond what is available in public records.

6. API-Specific Restrictions

If you have API access, the following additional restrictions apply:

  • API keys are non-transferable and must be kept secure
  • You are responsible for all activity using your API keys
  • Do not embed API keys in client-side code, public repositories, or publicly accessible applications
  • Do not exceed your plan's rate limits or use multiple keys to circumvent limits
  • Do not use the API to build services that compete with NE Provenance
  • Do not cache, store, or redistribute API responses beyond your organization's immediate internal use
  • Report compromised API keys to [email protected] immediately

7. Monitoring and Enforcement

We monitor usage patterns to detect violations of this policy. Patterns that suggest systematic extraction, redistribution, competitive analysis, AI training, or other prohibited use will trigger review.

7.1 Enforcement Actions

Depending on the severity and nature of the violation:

Minor violations or first offenses:

  • Contact you to discuss the usage pattern and resolve the issue
  • Issue a warning with request to cease prohibited activity
  • Temporarily restrict specific features or API access

Moderate violations or repeated offenses:

  • Temporarily suspend your account pending investigation
  • Permanently restrict certain features
  • Require Enterprise agreement for commercial-scale data integration

Severe violations (IP theft, unauthorized extraction, illegal activity):

  • Immediately terminate your account without refund
  • Permanently ban you from the Service
  • Pursue legal remedies including injunctive relief, damages, and recovery of attorneys' fees
  • Report to law enforcement authorities where applicable
  • Preserve evidence of violations for legal proceedings

7.2 Right to Investigate

We reserve the right to investigate suspected violations, access usage logs and activity data as needed for investigations, suspend accounts pending investigation, and cooperate with legal authorities.

8. Appeals

If you believe your account was suspended or terminated in error, contact [email protected] with your account email, explanation, and any supporting evidence. We will review appeals within 10 business days.

9. Reporting Violations

If you become aware of any violation of this policy, please report it to [email protected]. Include a description of the violation, any evidence, and relevant dates. We keep reporter identity confidential when possible and prohibit retaliation against good-faith reporters.

10. Changes to This Policy

We may update this AUP to address new types of abuse, protect our intellectual property, or comply with legal requirements. Material changes will be communicated with 30 days' notice. Continued use of the Service after changes constitutes acceptance.
